Universal Jurisdiction – An Overview

Universal Jurisdiction – An Overview

All organisational and individual members of the IAP are invited to join us for a webinar organised by the International Association of Prosecutors Global Training Academy in conjunction with the Office of the Attorney General of Switzerland.

Speaker: Andreas Mueller, Federal Prosecutor, Head International Criminal Law, Office of the Attorney General of Switzerland

Facilitator: Irina Beridze, Executive Programme Manager, International Association of Prosecutors

The principle of universal jurisdiction provides for a state's jurisdiction over crimes against international law, even when the crimes did not occur on that state's territory and where neither the victim nor perpetrator is a national of that state. It enables states or international organisations to prosecute individuals for serious crimes, such as genocide, war crimes, and crimes against humanity.

This webinar will provide an overview of the principles of universal jurisdiction, and outline some of the challenges and best practice in investigating and prosecuting crimes of universal jurisdiction. It will then provide examples of a relevant legal framework and case studies, based on the Swiss experiences.

This 60-minute webinar will be held in English and no interpretation will be provided. However, attendees can access live automated translated captions via the Zoom platform during the webinar.  All attendees will receive a certificate of attendance. The webinar is open to all IAP organisational and individual members.

Please note that this webinar will be recorded.

IAP EXECUTIVE COMMITTEE ON SANCTIONS AGAINST THE PROSECUTOR OF THE INTERNATIONAL CRIMINAL COURT

IAP EXECUTIVE COMMITTEE ON SANCTIONS AGAINST THE PROSECUTOR OF THE INTERNATIONAL CRIMINAL COURT

The International Association of Prosecutors (IAP) is the only worldwide organisation of prosecutors, prosecuting authorities and associations. It covers six continents and over 175 jurisdictions and represents thousands of prosecutors. The IAP is a non-political and non-governmental organisation. It is committed to upholding the rights of prosecutors and their organisations, to ensuring that prosecutorial standards are upheld, and to promoting the rule of law, fairness and respect for human rights.

The IAP is committed to upholding the principle of prosecutorial independence, which is an integral part of the rule of law. If States compromise the independence of prosecutors, the integrity of the criminal justice system is also compromised.

The IAP expresses deep concern regarding the Executive Order issued by the President of the United States on February 6, 2025, imposing sanctions on the International Criminal Court (ICC) and its officials for enforcement action arising out of the Gaza situation. It has resulted in the inclusion of Mr Khan KC (and his immediate family) on the list of Specially Designated Nationals and Blocked Persons.

The Prosecutor of the ICC acts within the jurisdiction conferred by the Rome Statute, the ICC's founding treaty, to which 125 countries are States Parties.

The ICC Prosecutor operates independently, and only investigates cases within the ICC's jurisdiction. Like other ICC officials, the ICC Prosecutor is appointed on the basis of experience and character.

The IAP respectfully urges the United States to uphold prosecutorial safeguards under international law and reconsider measures that may undermine judicial independence.

An Introduction to the UN Human Rights System: Understanding the UN Human Rights Council and its mec

An Introduction to the UN Human Rights System: Understanding the UN Human Rights Council and its mec

All organisational and individual members of the IAP are invited to join us for a webinar organised by the International Association of Prosecutors Global Training Academy in conjunction with the International Bar Association’s Human Rights Institute (IBAHRI).

Speaker:
Francesca Restifo, Senior Human Rights Lawyer and UN Representative of the International Bar Association’s Human Rights Initiative (IBAHRI)

Facilitator:
Irina Beridze, Executive Programme Manager, International Association of Prosecutors

This introductory session will provide a general overview of the key UN Human Rights bodies, mechanisms, and tools that make up the United Nations human rights system. For those who are new to the system or those who are seeking a refresher, this webinar will introduce or enhance understanding of how UN international human rights mechanisms function and how they may intersect with prosecutorial work.

Understanding the UN human rights mechanisms can be an essential factor for prosecutors. It equips them with tools and knowledge to uphold international legal standards, ensure fair trial guarantees, and contribute to accountability for serious human rights violations. These mechanisms—such as treaty bodies, Special Procedures, and the Universal Periodic Review, but also the investigation and accountability mechanisms of the UN human rights council—offer valuable sources of information, guidance, and jurisprudence that can support prosecutorial strategies, especially in cases involving human rights violations, and other crimes under international law. By engaging with the UN human rights system, prosecutors can better identify patterns of abuse, gather contextual evidence, and collaborate with international litigators to advance justice and prevent impunity. In short, integrating UN human rights perspectives may strengthen the integrity, legitimacy, and impact of prosecutorial work.

Participants will gain valuable insights into the role and the work of the UN Human Rights Council, its accountability and investigative mechanisms, and Special Procedures, and how these mechanisms can support accountability and justice efforts at the national and international levels. This is an opportunity to strengthen your practice through a deeper knowledge of the UN human rights architecture.

This 60-minute webinar will be held in English and no interpretation will be provided. However, attendees can access live automated translated captions via the Zoom platform during the webinar. All attendees will receive a certificate of attendance. The webinar is open to all IAP organisational and individual members.
