Financial Protocol

Protocol of the International Association of Prosecutors for the determination of subscriptions from organisational and individual members.

Recognising:

The need for transparency and accountability;

The desirability of certainty and foreseeability;

The requirement for fairness and equity;

The distinction between organisational members which are prosecuting agencies and those which are voluntary associations of prosecutors

This protocol establishes guidelines for the determination of subscriptions to be paid by organisational members.

1. Organisational members which are prosecuting agencies

  1. Annual subscriptions are payable primarily in accordance with the agencies' annual budgets as follows;
    1. USD 20 million and over - subscription USD6,000 (2000), USD 8,000 (2001), USD 10,000 (2002)
    2. USD 5 million up to USD 20 million - subscription USD3,000 (2000), USD 4,000 (2001), USD 5,000 (2002)
    3. Less than USD 5 million - subscription USD1,000 (2000), USD 1,500 (2001), USD 2,000 (2002)
  2. Prosecution agencies may subscribe larger sums.
  3. For each USD100 of subscription the Agency is entitled to one individual voting membership.
  4. Subscriptions of less than the prescribed sums may be negotiated upon the demonstration and acceptance by the Executive Committee (upon recommendation of the Finance Committee) of special circumstances, particularly financial hardship. Such circumstances may be demonstrated in a properly presented business case submitted to the Finance Committee

2. Organisational members which are associations of individual prosecutors

  1. Subject to sub-paragraph (c), annual subscriptions are payable primarily in accordance with the number of individual members of the member associafion at the rate of USD 2 per member with a minimum subscription of USD 300..
  2. Associations may subscribe larger sums.
  3. Subscriptions of less than the prescribed sums may be negotiated upon the demonstration and acceptance by the Executive Committee (upon recommendation of the Finance Committee) of special circumstances particularly financial hardship. Such circumstances may be demonstrated in a properly presented business case submitted to the Finance Committee.
  4. Provided, however, that any association may choose to pay or may be required to pay subscriptions in accordance with paragraph 1(a).

3. Individual members

The annual subscription for individual members for 2015 will be EUR 50

4. Invoices

Invoices will be issued to each organisational member by the Secretariat in accordance with the above. Invoices for individual members will be contained in the first edition of the IAP Newsletter each year. Yearly subscriptions are payable in full within 90 days of the date of invoice.

  1. Upon request, means of payment may be negotiated with the Secretary General.
  2. If payment of a subscription is not made within the specified tirne, membership will be suspended and a formal notice will be issued by the Secretary General. Such notice will be published in the next edition of the IAP Newsletter;
  3. Extension of time of payment may be negotiated with the Secretary.
